BackgroundCore Concept

Background

India's food regulatory framework is anchored in the Food Safety and Standards Act, 2006 (FSSA), which created the Food Safety and Standards Authority of India (FSSAI) as the apex statutory body. FSSAI sets science-based standards for food manufacture, storage, distribution, and sale. It replaced the older Prevention of Food Adulteration Act, 1954, consolidating several fragmented food laws under a single authority. The National Food Security Act, 2013 (NFSA) extended the state's food mandate to nutritional entitlement, covering subsidised grain for nearly two-thirds of the population. However, both laws were designed primarily around food safety and scarcity, not the challenge of overnutrition from processed foods.

The concept of HFSS (High in Fat, Sugar or Salt) foods as a distinct regulatory category comes from global public health frameworks, particularly WHO and UNICEF guidelines. These link repeated exposure to HFSS products with long-term dietary preference formation, especially in children. Countries such as Chile, Mexico, and the United Kingdom have enacted mandatory front-of-pack warning labels (FOPL) backed by statutory enforcement. India's FSSAI had proposed FOPL regulations earlier, but comprehensive rules remained pending. The Economic Survey 2025-26 formally called for FOPL, watershed advertising restrictions, and a legal definition of ultra-processed foods, signalling that the issue had moved from public health advocacy to mainstream economic policy.

The Advertising Standards Council of India (ASCI) handles food marketing complaints on a self-regulatory basis, without statutory enforcement power. School food environments lack a uniform national standard. This fragmented architecture, FSSAI for standards, ASCI for advertising, state governments for enforcement, has allowed aggressive HFSS marketing to continue largely unchecked.

The Topic Explained

Front-of-pack labelling is a consumer information tool placed on the front of a food package to give buyers a quick, at-a-glance signal about a product's nutritional risk. Unlike the detailed Nutrition Information Table on the back of the pack, FOPL is designed for low-literacy and time-pressed consumers. International evidence shows that warning-label designs, especially those using red colour and a clear text warning, are more effective at reducing purchase intent than traffic-light systems or nutrient-quantity displays.

FSSAI's proposed mechanism uses a red hexagonal warning label. The label would carry text such as 'High Fat', 'High Sugar', 'High Salt', or 'Highly Sweetened Beverage'. The thresholds for triggering the label are drawn from the Dietary Guidelines for Indians 2024. …
