BackgroundCore Concept

Background

India's parliamentary democracy was designed as a union of states, with the Constitution distributing legislative and executive powers between the Centre and states under Part XI (Articles 245–263). Yet the Constitution's framers did not fully anticipate how demographic asymmetry between regions would translate into political asymmetry over time. The Representation of the People Act, 1951 governs elections and party recognition, but it contains no mechanism to correct for the structural underrepresentation of states that have achieved faster demographic transition.

The reorganisation of states on linguistic lines after independence, a process shaped by popular pressure and the States Reorganisation Act, 1956, gave southern states a distinct political identity. This identity was reinforced by strong regional parties that emerged as counterweights to nationally dominant formations. The NCERT record of the 1977 general election is instructive: the north and south voted so differently that commentators questioned whether a single national mandate could be read from the results. That north-south electoral divergence has deepened, not narrowed, in the decades since.

Delimitation, the periodic redrawing of constituency boundaries, is governed by Articles 82 and 170 of the Constitution, which mandate readjustment of Lok Sabha and state assembly seats after each census. The Delimitation Commission, constituted under the Delimitation Act, carries out this exercise. Its orders are non-justiciable: they cannot be challenged in any court. This structural feature makes pre-legislative advocacy the only effective channel for states seeking to influence outcomes.

The Topic Explained

The core concern of southern states is arithmetical. Southern states, particularly Tamil Nadu, Kerala, Karnataka, Andhra Pradesh, and Telangana, achieved demographic transition (falling fertility rates) earlier than most northern states. If Lok Sabha seats are redistributed on the basis of current population data, states with larger populations will gain seats and states with smaller populations will lose them. Southern states would effectively be penalised for having implemented family planning more successfully. This creates a direct conflict between the democratic principle of proportional representation and the federal principle of equitable participation.

The Delimitation Commission is constituted by the President and functions independently of Parliament. Its orders, once finalised, have the force of law and override any inconsistent provision in state law. The Commission's independence is a deliberate design choice to insulate boundary-drawing from partisan manipulation. …
