BackgroundCore Concept

Background

India's experiment with decentralised governance has its constitutional roots in the Directive Principles of State Policy, which directed the state to organise village panchayats and endow them with powers to function as units of self-government. For decades, this remained an aspiration rather than a reality. The turning point came in 1992–93, when the 73rd and 74th Constitutional Amendments were enacted. The 73rd Amendment created a constitutional framework for rural local bodies (panchayats), while the 74th Amendment did the same for urban local bodies (municipalities). Both amendments added the Eleventh and Twelfth Schedules to the Constitution, listing 29 and 18 subjects respectively that could be transferred to local bodies. They also mandated the creation of State Finance Commissions and District Planning Committees to support local governance.

Despite this constitutional architecture, the actual transfer of powers has remained incomplete. The amendments used enabling language, states may transfer functions, rather than mandatory language. This gave state governments discretion to decide how much authority to devolve. As a result, the depth of decentralisation has varied enormously across states. The 16th Finance Commission, currently deliberating its recommendations, has renewed attention to how fiscal transfers to local bodies should be structured to make them more effective and predictable.

The Topic Explained

The core framework for evaluating decentralisation in India is the concept of the 3Fs: Funds, Functions, and Functionaries. Genuine decentralisation requires all three. Local bodies must have adequate financial resources, a clear set of functions to perform, and their own staff to carry out those functions. In practice, many local bodies in India lack all three. Functions listed in the Eleventh and Twelfth Schedules are often not transferred. Staff remain under state government control. And finances depend heavily on grants from above, with little own-source revenue.

Fiscal dependence is a structural weakness. Local bodies in most states rely on transfers from state and central governments. These transfers are often tied to specific schemes, leaving little discretionary spending. This makes long-term planning difficult. …
