BackgroundCore Concept

Background

The district judiciary is the first point of contact between citizens and the formal justice system. It handles the overwhelming majority of civil and criminal cases in India. The Constitution of India does not directly fix the retirement age of district judges; this falls within the domain of state legislation and service rules, subject to the overall superintendence of the respective High Courts under Article 235. The Supreme Court exercises supervisory jurisdiction over the entire judicial system through Article 136 (special leave to appeal) and through suo motu proceedings.

Judicial independence, affirmed as a basic feature of the Constitution in Kesavananda Bharati v. State of Kerala (1973), requires security of tenure as one of its pillars. The NCERT framework on judicial independence identifies fixed tenure and a difficult removal procedure as the two primary structural guarantees. However, security of tenure is meaningless if the judiciary is chronically understaffed. The gap between sanctioned strength and working strength of judicial officers has been a persistent structural problem, documented in successive Law Commission reports and Supreme Court orders.

The Law Commission of India and the National Court Management Systems Committee have repeatedly flagged that India's judge-to-population ratio is far below the recommended level of 50 judges per million population, against which India's actual ratio remains in single digits at the district level. This structural deficit directly feeds the pendency crisis.

The Topic Explained

Pendency in the district judiciary arises from three interacting causes: insufficient judicial strength, high attrition of experienced officers, and slow recruitment. The retirement age of district judicial officers is set by state service rules. Currently, most states fix it at 60 years. The Supreme Court's push to raise this to 62 years is aimed at retaining experienced officers who would otherwise leave the system precisely when they are most productive.

The constitutional architecture places district judges under the control of the High Court of the respective state, with the Governor acting on the advice of the High Court in matters of appointment and promotion under Article 233. Service conditions, including retirement age, are governed by state rules. This means any enhancement requires a formal amendment to state service rules, which is why the Supreme Court has directed state governments to act within a fixed timeframe.

The financial objection raised by several states rests on two concerns. …
