BackgroundCore Concept

Background

The International Court of Justice (ICJ), seated at The Hague in the Netherlands, is the principal judicial organ of the United Nations. It was established in 1945 under the UN Charter and began functioning in 1946. The ICJ adjudicates disputes between states, not individuals. This distinguishes it fundamentally from the International Criminal Court (ICC), which prosecutes individuals for crimes such as genocide and war crimes. Only UN member states can be parties before the ICJ, and the court's jurisdiction is generally consensual: a state must accept the court's authority, either through a treaty clause, a special agreement, or a unilateral declaration.

The Convention on the Prevention and Punishment of the Crime of Genocide, commonly called the Genocide Convention, was adopted by the UN General Assembly in 1948 and entered into force in 1951. It was the first human rights treaty adopted by the General Assembly after World War II. The convention defines genocide as acts committed with intent to destroy, in whole or in part, a national, ethnic, racial, or religious group. Crucially, the convention contains a dispute-resolution clause: any disagreement between signatories over the convention's interpretation, application, or fulfilment may be referred to the ICJ. This clause is the legal gateway through which states like Nicaragua and South Africa have brought cases before the court. The convention currently has 154 signatories, including Nicaragua, Germany, Israel, and India. The term 'genocide' itself was coined by Polish lawyer Raphael Lemkin in 1944, and his advocacy was instrumental in the convention's eventual adoption.

A recurring challenge in international law is enforcement. Even when the ICJ delivers a binding verdict, compliance depends on the willingness of the losing state or, in extreme cases, action by the UN Security Council. The Security Council's veto structure means that powerful states or their close allies can block enforcement. This enforcement gap is central to the broader debate about UN reform and the limits of international legal accountability, a tension that becomes sharper as sovereign nationalism reasserts itself against multilateral institutions.

The Topic Explained

The ICJ's jurisdiction in genocide cases rests specifically on Article IX of the Genocide Convention, which grants the court authority to hear disputes between signatories. A state bringing a case does not need to prove it was itself a victim of genocide. It can invoke the convention as a third-party state asserting that another signatory has violated its obligations to prevent or punish genocide. This is the legal theory Nicaragua is using against Germany: not that Nicaragua was harmed, but that Germany, as a signatory, breached its obligation to prevent genocide by supplying arms to Israel.

The ICJ process has two main stages. First, the court determines jurisdiction and admissibility: whether it has the authority to hear the case and whether procedural requirements were met. Germany's current argument, that Nicaragua did not follow proper procedures and that parts of the case fall outside ICJ jurisdiction, is a challenge at this first stage. …
