"Government Weighs Delimitation Timing Amid Political and Federal Concerns"
Delimitation
Redrawing of constituency boundaries and reallocation of seats based on population data.
Freeze (on seats)
Constitutional bar on changing total Lok Sabha/Assembly seats despite population change.
Article 82 of the Constitution requires Parliament to readjust the allocation of seats in the Lok Sabha among the states after every Census, through a Delimitation Act. India has constituted four Delimitation Commissions so far, in 1952, 1963, 1973 and 2002, each a quasi-judicial body headed by a retired Supreme Court judge. Under the Delimitation Act, the Commission's orders have the force of law and cannot be challenged in any court, and neither Parliament nor state legislatures can modify them once notified.
Since a 1976 constitutional amendment, the total number of Lok Sabha and state Assembly seats has been frozen, even though redrawing of individual constituency boundaries continued. The freeze was meant to prevent states from losing political weight for successfully controlling population growth, since a purely population-based allocation would reward higher fertility. The 84th Constitutional Amendment, 2001 extended this freeze until the first Census conducted after 2026. That extension is now due to lapse once the ongoing Census exercise is completed, unless Parliament acts again to prolong it.
Layered on top of this is the Nari Shakti Vandan Adhiniyam, 2023, which reserves 33% of seats for women in the Lok Sabha and state Assemblies, with a sub-reservation for women from Scheduled Castes and Scheduled Tribes within their existing quotas. The Act specifies that this reservation will apply for 15 years, but only after delimitation is carried out based on the first Census taken after the Act's commencement. This ties the timeline for women's political representation directly to the unresolved question of when delimitation will actually happen.
The political stakes of a population-based delimitation are considerable. States in the south and some in the west have achieved sharper declines in fertility than several northern states. A delimitation exercise using current population data could shift a substantial number of Lok Sabha seats toward more populous northern states, reducing the relative political weight of states that performed better on demographic transition. This structural tension explains why regional parties, particularly from the south, have long resisted an early delimitation.
A Constitution (131st Amendment) Bill, 2026 sought to combine two linked reforms: expanding the Lok Sabha's total strength from 543 seats to as many as 850, and advancing the schedule for implementing the women's reservation law to the 2029 general election. …
