"TRAI Amends Rules to Curb Spam Calls Using AI Detection"
UCC
Unsolicited Commercial Communication, unwanted promotional calls or messages sent without consumer consent.
CLI
Calling Line Identification, the sender's number or identity shown to the call recipient.
TRAI derives its power to curb unsolicited commercial communications (UCC) from the TRAI Act, 1997. Under Section 11(1)(b) of this Act, TRAI can issue directions to protect consumer interest in the telecom sector. The current framework is the Telecom Commercial Communications Customer Preference Regulations (TCCCPR), 2018. These regulations replaced the earlier 2010 rules. They created the National Customer Preference Register, commonly called the Do Not Disturb (DND) registry. Through this registry, subscribers record their consent preferences for commercial calls and messages. This consent-based system reflects the same underlying value as the right to privacy recognised under Article 21. A person's telecom connection should not be used for unwanted intrusion without consent.
Over time, UCC senders found ways around the DND system. Unregistered telemarketers, spoofed sender identities, and bulk automated calls became common. TRAI first responded with a Distributed Ledger Technology (DLT) platform. This required senders and telemarketers to register their headers and content templates. More recently, major telecom operators deployed AI/ML-based systems to detect suspected spam. The Third Amendment Regulations, 2026 turn these technology-driven practices into binding rules. They follow a public consultation process that began in early 2026 and included an Open House Discussion with stakeholders.
The central change is a new provision, Regulation 21A. It requires Telecom Service Providers (TSPs) to identify sender Calling Line Identifications (CLIs) that have a high probability of being used for UCC. TSPs must share this information with each other. If five or more CLIs linked to one sender are flagged within ten days, Access Providers must investigate further. This can include KYC re-verification, physical verification, barring of outgoing services, or disconnection for repeated violations. Certain numbering series meant for authorised use, such as 140xx, 1600xx and 1601xx, are excluded from being flagged as spam. This protects legitimate commercial and government messages.
The amendment also creates a formal category for Application-to-Person (A2P) calls. …
