BackgroundCore Concept

Background

India's electoral roll system rests on Article 324, which vests the Election Commission of India (ECI) with superintendence, direction, and control over elections, and Article 326, which guarantees universal adult suffrage as the constitutional foundation of the right to vote. The Representation of the People Act, 1950 and the Registration of Electors Rules, 1960 govern how rolls are prepared and maintained. Ordinarily, rolls are updated through continuous annual revisions carried out by Booth Level Officers, with political party agents built in as a check. Section 21 of the 1950 Act allows the ECI to order special revisions when it judges existing rolls deficient; historically this power has been used for specific constituencies, not at the nationwide scale seen in the current Special Intensive Revision (SIR).

This is not the first time a mass verification drive has produced large-scale exclusion. During the first general election, nearly 40 lakh women were initially left off draft rolls, recorded only as "wife of" or "daughter of" someone, forcing the ECI to order a revision before polling could proceed. The episode is a reminder that large verification exercises, however well-intentioned, are prone to systemic errors that can fall disproportionately on the same categories of voters each time.

The ECI's authority extends beyond roll maintenance. Under the Election Symbols (Reservation and Allotment) Order, 1968, it also adjudicates disputes over splits and mergers of recognised political parties, a distinct exercise of its constitutional mandate separate from roll revision. The right to vote itself, though it flows from Article 326, has been held by the Supreme Court to be a legal right conferred through the Representation of the People Act, not a fundamental right under Part III. This distinction matters because it shapes how much protection an excluded elector can claim as of right, versus how much depends on the ECI's own administrative correction machinery.

The Topic Explained

The SIR proceeds in stages. Enumeration forms are distributed door to door, and Booth Level Officers are expected to verify every household. Voters are then required to link their entries to the more comprehensive rolls prepared in the early 2000s; anyone who cannot be matched, or whose documents raise questions, is flagged for a "logical discrepancy." Judicial officers deployed for verification decide, at this stage, who is provisionally excluded. A draft roll is then published, followed by a claims-and-objections window during which the excluded elector, not the ECI, carries the burden of proving continued eligibility.

Those still left out after this window can appeal to statutory appellate tribunals. …
