Foods high in fat, sugar or salt, linked to diet-related non-communicable diseases.
India's food regulation rests on the Food Safety and Standards Act, 2006 (FSS Act). This law created the Food Safety and Standards Authority of India (FSSAI) as the country's apex food regulator. FSSAI replaced the older Prevention of Food Adulteration Act, 1954, and brought fragmented food laws under one statute. FSSAI is an autonomous statutory body under the Ministry of Health and Family Welfare. It is headed by a Chairperson and a Chief Executive Officer, not by the Director General of Health Services, a distinct office within the same ministry.
FSSAI already enforces detailed labelling rules under the Food Safety and Standards (Packaging and Labelling) Regulations, 2011. These regulations make it mandatory for a pre-packaged food's main label to carry the list of ingredients, nutrition information, and a veg/non-veg symbol. A recommendation about possible allergic reactions is not mandatory; it is left to the manufacturer's discretion. This back-of-pack framework tells a consumer what is inside a product, but it does not flag foods that are unhealthy in large quantities.
Front-of-pack warning labels are meant to close this gap. Countries such as Chile, Mexico, and the United Kingdom adopted such systems years ago, using symbols like black octagons or traffic-light colours to flag high sugar, salt, or fat content. In India, growing concern over diet-linked non-communicable diseases pushed the Supreme Court to intervene. The Court has held that food labelling reform serves the right to health under Article 21 and the state's duty to raise nutrition levels under Article 47. It has been monitoring FSSAI's rule-making timeline directly, an unusual instance of judicial oversight over delegated legislation.
Front-of-pack labelling (FoPL) places a simple warning symbol on the most visible part of a package, separate from the detailed nutrition table usually printed on the back. FSSAI has proposed a red hexagon symbol, broadly similar to the format used in Canada, to flag high levels of sugar, salt, or saturated fat, the three nutrients of concern. If a product exceeds the threshold for only one nutrient, that nutrient alone appears in the hexagon. If it exceeds thresholds for two or three nutrients, all of them appear together within a single hexagon rather than through separate symbols. …
