"Demographic Panel's Religion-wise Data Request Stumps State Governments"
Principled distance
India's secularism model letting the state intervene in religious matters for reform, unlike strict separation.
Fifth Schedule
Constitutional provision protecting tribal land and governance in Scheduled Areas outside the Northeast.
India's Constitution does not erect a strict wall between religion and state on the American model. Instead, it follows what scholars call 'principled distance': the state maintains equal respect for all religions while retaining the power to intervene in religious practice for social reform. The word 'secular' was inserted into the Preamble only by the 42nd Constitutional Amendment Act, 1976, though Articles 25 to 28 guaranteed individual and group freedom of religion from the start. This is different from the US First Amendment, which bars the government from either establishing or interfering with religion. India's model allows the state to regulate temple management, reform personal laws, and protect minority educational institutions under Article 30, none of which the American separationist approach permits.
Routine government records in India generally avoid classifying citizens by religion, except in two places: the decennial Census, conducted under the Census Act, 1948, which records self-declared religion, and birth certificates, which note the religion of the newborn. This restraint is a deliberate feature of the secular design, not an oversight. When the Sachar Committee was set up in 2005 to study the socio-economic and educational status of Muslims, the then Opposition questioned its constitutional validity, arguing that religion-based data collection was socially divisive. That same objection is now relevant in reverse, since a new panel is asking states to generate religion-wise data across many everyday domains that have never been recorded this way.
A related constitutional thread concerns tribal areas. The Fifth Schedule (under Article 244(1)) empowers Governors to restrict or prohibit the transfer of land from tribals to non-tribals in Scheduled Areas, while the Sixth Schedule (under Article 244(2)) provides autonomous district councils in parts of the Northeast. Both exist to protect tribal identity, land, and culture from external pressure, which is directly relevant when a panel asks states about land transfers and religious conversion trends among Scheduled Tribes.
The High-Level Committee on Demographic Changes (HLCDC) was constituted by the Ministry of Home Affairs to study demographic changes arising from illegal immigration and other 'abnormal' causes, and to recommend measures to address them. It is headed by a retired Supreme Court judge. Its questionnaire covers five broad areas: demographic trends, migration, administrative challenges, institutional mechanisms, and state-level measures already adopted.
The committee has asked states for fifteen years of religion-wise, district-wise data on birth registrations, vehicle registrations, school enrolment, and property transactions. …
