BackgroundCore Concept

Background

The GST Council is a constitutional body under Article 279A. The 101st Constitutional Amendment Act, 2016 added this article. The Union Finance Minister chairs the Council. It also includes the finance minister of every state and union territory with a legislature. Council decisions need a three-fourths majority. States hold two-thirds of the vote and the Centre holds one-third. In practice, the Council usually works by consensus.

GST started on 1 July 2017. It brought many separate central and state taxes under one system. GST subsumed 17 central and state taxes and 23 cesses into one unified tax. Before GST, a good was taxed again at every state border. Tax paid at one stage was not always credited at the next stage. This created a tax-on-tax effect. Under GST, a business gets credit for tax already paid on its inputs. This is called input tax credit, or ITC. This means tax is really charged only on the value a business adds at each stage. This single mechanism lets GST create one common national market. Before, there were many separate state markets. A few essential items stay exempt to protect consumers. Unprocessed food grains are not taxed under GST. Plain newspapers without advertising content are not taxed under GST.

The Council's 56th meeting was held about a year earlier. It focused on rates. It cut India's four-tier GST structure down to two main slabs: 5% and 18%. There is also a special 40% rate for select goods and services. The 57th meeting was held recently. It shifted attention from rates to the process of paying and administering tax. It covered registration, returns, refunds and dispute resolution.

GST creates a single national market. It allows input tax credit at each stage. Tax is charged only on the value added by each business. It is not charged on the full price repeatedly.

The Topic Explained

Registration is where a business first enters the GST system. The Council has approved clearer documentation. It approved a simpler application form. It approved a more guided online filing interface. These changes are meant to cut rejections and queries. For routine changes to registration details, approval will now happen automatically on the portal. There is one exception: a change in the Principal Place of Business. This still needs manual review. However, it does not need manual review if the taxpayer used the automatic registration route. On cancellation, the reforms reduce how often a tax officer must get involved. Automatic cancellation powers are being phased in. Suo-moto cancellation powers (meaning: cancellation by a tax officer on their own initiative) are being narrowed. They are replaced by a system that cancels or restores registration. Registration is cancelled or restored based on whether a business files its returns on time. …
