BackgroundCore Concept

Background

India's reservation system is built on two different constitutional ideas. The first is caste identity. This is used for Scheduled Castes (SCs) and Scheduled Tribes (STs). The second is social and educational backwardness. This is used for Other Backward Classes (OBCs) and state-level Backward Class (BC) lists. Article 341 gives the President power to specify Scheduled Castes for a state or Union Territory. Only Parliament can change this list by law. A related provision, Article 366(24), defines Scheduled Castes as the communities notified under Article 341.

For Scheduled Castes, religion has always mattered. The Constitution (Scheduled Castes) Order, 1950 was issued under Article 341. Paragraph 3 of this Order states that no person who professes a religion other than Hinduism, Sikhism or Buddhism can be deemed a member of a Scheduled Caste. Sikhs and Buddhists were added to this list later by amendment. Christians and Muslims were not. This reflects an old assumption. Untouchability-based caste discrimination was mainly a feature of these three religions.

Backward Class status works differently. It comes from Articles 15(4) and 16(4). These allow the state to make special provisions for socially and educationally backward classes. Unlike the SC framework, there is no single national religion-based bar here. Instead, a BC list is built community by community. A state identifies which specific groups are backward enough to deserve reservation. This difference in design is exactly what the Supreme Court's recent order turned on.

The Nari Shakti Vandan Adhiniyam provides for reservation of seats for women in the Lok Sabha and state legislative assemblies.

The Topic Explained

The case began when a man converted from Hinduism to Islam. He sought a community certificate as a 'Muslim Lebbai'. This is one of the communities on Tamil Nadu's Backward Class (Muslim) list. Tamil Nadu recognises seven Muslim communities under this list. These include Labbais, Deccanis and Mapillas. When the revenue authority refused him the certificate, he challenged a 2024 state government order. That order had allowed certain converts to claim BC (Muslim) status. The Madras High Court struck down that order in June. The court held that conversion alone did not prove he belonged to one of the specifically notified communities. The Supreme Court has now upheld this view.

The key legal point is that Backward Class status depends on notified community membership, not religion alone. Simply adopting a new religion does not automatically place a person inside a specific social community. That community has been studied and recognised as backward. A convert must show real social assimilation into that community. …
